The Government of the Russian Federation established the rate of remuneration for private copying

The order of payment and collecting and the rates of remuneration are established by the regulation of the Government of the Russian Federation “About the remuneration for free reproduction of phonograms and audiovisual products for private purposes” of October 14th 2010 № 829. The remuneration rate is 1% from realization price of equipment and material carriers and 1% from custom price of equipment and material carriers imported to the custom territory of the Russian Federation.
The remuneration should be paid by importers and producers of the equipment and material carriers used for private copying and included in the certain confirmed list. This list includes magnetic, optical and semi-conductor carriers, and also the equipment with sound or video recorders.
The importers and producers will pay out the certain remuneration in accordance with agreements concluded with sate accredited organization.

By the general rule, manufacturers pay remuneration quarterly not later than 10th date following after expired quarter. Simultaneously they ought to represent the report of realization to the state accredited organization.
The importers should inform the accredited organization about the import of the goods in time, not exceeding 10 working days from the date of their premise under a customs procedure of release for internal consumption.
Within the next 20 working days the state accredited organization checks the information received from the importer according to the data given by customs bodies and informs the importer about the amount of payment which should be made within 10 working days.

The compensation payment won’t be paid by manufacturers of that equipment and those material carriers which are an export subject, and also by manufacturers of the professional equipment which is intended for use in house conditions.
Besides, if the equipment is made from the accessories completely made in the Russian Federation or imported to the territory of the Russian Federation and the remuneration payment was already done, the certain manufacturer should not pay anything.
The regulation of the Government of the Russian Federation “About the remuneration for free reproduction of phonograms and audiovisual products for private purposes” of October 14th 2010 № 829 also confirms the procedure of distribution and payment the remuneration to authors, performers, producers of phonograms and audiovisual for free reproduction of phonograms and audiovisual products exclusively for private purposes.

The collected remuneration is distributed to the right-holders in the following proportion: 40 % – to authors, 30% to performers and producers of phonograms and audiovisual products. Payment is made in the terms provided by the charter of the accredited organization, but isn’t more rare than once a year.
